INFORMATION TEXT ON THE PROCESSING OF PERSONAL DATA

MAVİAY ENERGY LIGHTING ELECTROMECHANICAL SOFTWARE TECH. CONSTRUCTION INDUSTRY AND TRADE LTD. CO. (hereinafter referred to as "COMPANY") is committed to protecting and ensuring the security of your personal data. In this context, we would like to inform you transparently, as the Data Controller, about the methods of collecting your personal data, the purposes of processing, the legal grounds for processing, and your rights in accordance with the Law on the Protection of Personal Data No. 6698 (hereinafter referred to as the "Law") and relevant legislation to protect the fundamental rights and freedoms of individuals, primarily the privacy of private life. The COMPANY reserves the right to update this Personal Data Protection Information Text in line with any changes that may occur in the current legislation.

Processing of Your Personal Data:

According to the Law, the collection, recording, storage, preservation, modification, rearrangement, disclosure, transfer, acquisition, making available, classification, or prevention of the use of personal data through automated or non-automated means as part of any data recording system is considered as "processing of personal data."

Purpose of Processing

The personal data collected by us will be processed by the COMPANY for the following purposes:

  • To carry out necessary work by relevant departments for the execution of commercial activities conducted by the Company and to carry out related business processes,
  • To plan and implement the Company's commercial and/or business strategies,
  • To improve employee performance and satisfaction, determine training and career plans, or ensure occupational safety,
  • To plan and execute customer relationship management processes,
  • To ensure the legal, technical, and commercial security of the Company and the individuals in a business relationship with the Company,
  • To fulfill the obligations undertaken under the contracts concluded in accordance with the provisions of relevant legislation, to be able to fulfill our legal obligations and to exercise our rights arising from the legislation in force,
  • To provide information to public officials when requested and in accordance with the law regarding matters related to public safety,
  • To ensure the safety of employees, guests, customers, and the Company, and to control entries and exits,
  • To plan and execute production and/or operation processes,
  • To ensure the implementation of the Company's human resources policies,
  • To be used as evidence in potential disputes,
  • To ensure the satisfaction of the social and economic rights of employees within the Company,
  • To conduct advertising and marketing activities by controlling customer satisfaction,
  • To organize the commercial books, invoices, payment instruments, and payrolls that the Company needs to prepare,
  • To enable the processing of external resources utilized within the Company and to complete processes such as maintenance, repair, and updates,
  • To evaluate the recruitment processes of job candidates and assess alternative positions,
  • To conduct corporate correspondence, in accordance with the personal data processing conditions and purposes stated in Articles 5 and 6 of the KVK Law.

Parties to Whom Data is Transferred and the Purpose of Transfer

Your personal data collected by our Company may be transferred to our business partners, suppliers, Company officials, the institution performing the delivery, our shareholders, legally authorized public institutions, and private individuals in accordance with the conditions and purposes of personal data processing stated in Articles 8 and 9 of the KVK Law.

Collection Method and Legal Grounds

Your personal data may be collected by the COMPANY through real or legal persons authorized to process data for the purposes specified in this Personal Data Processing Information Text; through declarations, application forms, forms filled out on the website, documents requested to create a personnel file, various contracts, all types of information forms, surveys, job application forms, and through all written, verbal, and electronic media, via automated or non-automated methods. Your personal data can be processed and transferred in accordance with the personal data processing conditions and purposes specified in Articles 5 and 6 of the Law.

Duration of Storage of Personal Data

The COMPANY will retain personal data for the duration required by the purposes specified in this Personal Data Processing Information Text and relevant legislation. Additionally, in the event of any disputes arising with the data owner, the COMPANY may retain personal data for the periods specified in the legislation concerning the statute of limitations.

Measures and Commitments Regarding Data Security

The COMPANY commits to taking the necessary technical and administrative measures to ensure the appropriate security level:

  • To prevent the unlawful processing of personal data,
  • To prevent unlawful access to personal data, and
  • To ensure the preservation of personal data,

and will not disclose the personal data obtained in violation of this Personal Data Processing Information Text and relevant legal regulations to others or use it for purposes other than processing.

Your Rights Under the Law

Regarding the processing of your personal data, you have the following rights as a data controller under Article 11 of the Law on the Protection of Personal Data No. 6698:

  1. To learn whether your personal data has been processed,
  2. If your personal data has been processed, to request information about it,
  3. To learn the purpose of processing your personal data and whether they are used in accordance with their purpose,
  4. To know the third parties to whom your personal data has been transferred within the country or abroad,
  5. If your personal data is incomplete or incorrectly processed, to request correction of it,
  6. To request the deletion or destruction of your personal data under the conditions stipulated in Article 7 of the Law,
  7. To request that the transactions carried out pursuant to (d) and (e) be notified to the third parties to whom your personal data has been transferred,
  8. To object to the emergence of a result against you that is exclusively based on the automated processing of your data,
  9. To request compensation for the damages you have suffered due to the unlawful processing of your personal data.

You can submit your requests regarding your rights listed above by filling out the application form on our website in accordance with the instructions, delivering a signed copy of the form in person along with identity verification documents to Talatpaşa Mahallesi 4006. sk. L Blok apt. no: 46 Kocasinan/Kayseri, sending it via notary or other methods specified in the Law, or by sending the relevant form securely with an electronic signature to maviayltd@hs01.kep.tr. Your requests will be concluded as soon as possible and no later than thirty days free of charge, depending on the nature of your request; however, the Company reserves the right to charge you a fee according to the tariff determined by the Personal Data Protection Board if an additional cost arises.
